photography services agreement

This Photography Services Agreement (“Agreement”) is entered into by and between nC. Isa Media LLC (“Photographer”, “we”, “us”, or “our) and the undersigned client (“Client”, “you”, or “your”).

By electronically signing this Agreement and competing your booking through our website, you acknowledge that you have read, understood, and agree to the following terms and conditions.

Services

Photographer agrees to provide photography services as selected by Client during the online booking process (“Services”). Specific details including date, time, location, package selection, and deliverables are outlined in the booking confirmation and invoice, which are incorporated into this Agreement by reference.

Booking & Payment

  • A signed Agreement and payment (or retainer, if applicable) are required to secure your booking.

  • All prices are listed in U.S. dollars.

  • Sessions are not confined until payment has been successfully processed.

  • Any additional services, time, or products requested beyond the original booking are not guaranteed and may incur additional fees.

Travel Fees

C. Isa Media LLC is based in Yucaipa, California. Travel within 0-50 miles of Yucaipa is included at no additional cost.

Sessions located outside this range may be subject to additional travel fees, calculated based on one-way distance using Apple Maps, Google Maps, or a comparable mapping service:

  • Regional Zone (51-150 miles): $100 flat travel fee

  • Extended Zone (151-299 miles): $200 flat travel fee

  • Destination Sessions (300+ miles or sessions requiring air travel): Additional costs may apply, including but not limited to airfare, lodging, rental vehicles, parking, tolls, and related travel expenses.

All applicable travel fees will be disclosed prior to booking and reflected in the Client’s invoice, booking confirmation, checkout summary, or written agreement, and are non-refundable once incurred.

Cancellations, Rescheduling & Refunds

  • Client must provide at least 5 days notice to reschedule a session.

  • Retainers or booking fees are non-refundable but may be applied to a reschedule session at Photographer’s discretion.

  • If Client fails to appear or cancels outside the allowed notice period, all fees paid are forfeited.

  • Photographer reserves the right to reschedule due to illness, emergency, unsafe conditions, or circumstances beyond our control.

Client Responsibilities

Clients agrees to:

  • Arriving on time and being prepared for the session,

  • Obtaining any required permits or permissions for the session location unless otherwise agreed upon.

  • Ensuring cooperation of all participants

  • Understand that Photographer is not responsible for missed images due to lack of cooperation, late arrival, or unforeseen circumstances.

Artistic Style & Editing

Client acknowledges that:

  • Photographer’s work is subjective and based on their artistic style.

  • Editing, color correction, and retouching are performed at Photographer’s discretion.

  • Requests for re-edits beyond the PHotographer’s standard workflow may incur additional fees.

Image Delivery

  • Final edited images will be delivered via a private online gallery within 3 weeks unless otherwise stated.

  • Turnaround times may vary during peak seasons.

  • Photographer is not responsible for gallery expiration or loss of files after _ days from delivery.

Copyright & Usage Rights

  • Photographer retains full copyright to all images.

  • Client is granted a non-exclusive, non-transferable license to use the images for personal use only, unless otherwise agreed in writing.

  • Images may not be altered, sold, or used for commercial purposes without written permission.

  • Photographer may use images for portfolio, website, social media, marketing, and promotional purposes unless Client submits a written opt-out request prior to the session.

Model Release

Client grants Photographer permission to photograph and use the likeness of all participants included in the session for lawful purposes, including marketing and portfolio use, unless otherwise stated in wiring.

Limitation of Liability

  • Photographer is not liable for circumstances beyond their control, including weather, venue restrictions, equipment failure beyond reasonable safeguards, or acts of third parties.

  • Photographer’s liability is limited to the amount paid by Client under this Agreement.

  • Photographer is not responsible for personal injury or property damage during the session.

Indemnification

Client agrees to indemnify and hold harmless Photographer from any claims, damages or liability arising from Client’s actions, participants, or chosen locations during the session.

Force Majeure

Photographer shall not be liable for failure to perform due to events beyond reasonable control, including but not limited to natural disasters, government actions, illness, or emergencies.

Governing Law

This Agreement shall be governed by and interpreted in accordance with with the laws of the State of California.

Electronic Signature & Acceptance

By clicking to sign electronically and completing your booking, you acknowledge that:

  • You have read and understood this Agreement

  • You agree to be legally bound by its terms

  • Your electronic signature is the legal equivalent of a handwritten signature
